Keith Nelson and Associates Limited Terms of Service Agreement
1. Introduction
1.1. These terms of service (the “Agreement”) govern the relationship between Keith Nelson and Associates Limited, (referred to as “we,” “us,” or “our”) and the patient or client (referred to as “you” or “your”) regarding the provision of dental healthcare services (referred to as “Services”) as outlined herein, in compliance with New Zealand law.
2. Booking and Acceptance
2.1. You may request an appointment for healthcare Services through Keith Nelson and Associates Limited’s website, or in writing through email at infofranklin@keithnelson.co.nz , or via phone 09 378 0877, or while in at the clinic, or through other accepted channels.
2.2. All appointments are subject to acceptance by us, and we reserve the right to refuse or reschedule any appointment in accordance with New Zealand law.
3. Pricing and Payment
3.1. Prices for our healthcare Services are based on service. We can provide quotation if requested but prices are subject to change depending on treatment required and pricing increases as determined by us, in compliance with New Zealand’s pricing regulations.
3.2. Payment must be made on the day via accepted payment methods, and any applicable insurance coverage or fees, will be communicated to you at your appointment, adhering to New Zealand’s payment standards.
3.3. Payment options are available but must be communicated to the team within 7 days post your appointment. Failure to pay your account after 30days will result in your account being sent for collection with collection fees applicable.
4. Appointment and Cancellation
4.1. We will make reasonable efforts to accommodate your appointment preferences while following New Zealand’s healthcare guidelines.
4.2. You may cancel or reschedule an appointment by providing advance 24 hours’ notice before your appointment as specified in our cancellation policy. A fee will be applicable if 24 hours’ notice is not given.
5. Privacy and Confidentiality
5.1. We are committed to maintaining the privacy and confidentiality of your personal and medical information as outlined in our separate Privacy Policy and aligning with New Zealand’s privacy regulations.
6. Treatment and Care
6.1. We will provide healthcare Services in accordance with professional standards and guidelines as set forth by New Zealand’s healthcare authorities.
6.2. Any additional instructions, restrictions, or post-care recommendations will be communicated to you as part of your treatment plan, complying with New Zealand’s healthcare practices.
7. Liability
7.1. Our liability for any claim arising out of or related to this Agreement shall not exceed the cost of the Services provided to you, in accordance with New Zealand’s legal standards.
7.2 Should you be unhappy with our services; we agree to comply with the Consumer’s Guarantee’s Act and offer a resolution suitable to you.
7.3 Treatment failure within 12 months of the treatment will be replaced at no to cost you.
8. Intellectual Property
8.1. Any intellectual property rights associated with our healthcare Services, including medical records and treatment plans, shall remain the property of Keith Nelson and Associates limited unless otherwise specified to share between other healthcare professionals or requested by the patient or for compliance purposes.
9. Termination
9.1. We may terminate this Agreement immediately if you breach any of its terms or engage in disruptive or unsafe behaviour towards us, consistent with New Zealand law.
10. Governing Law
10.1. This Agreement shall be governed by and construed in accordance with the laws of New Zealand, and any disputes shall be subject to the exclusive jurisdiction of the courts in New Zealand.
11. Amendments
11.1. We may amend these terms of service at any time, and such amendments will take effect upon your acceptance or continued use of our healthcare Services, consistent with New Zealand’s legal requirements.
